Terms and Conditions for Paid Services, Payments, and Refunds
Article 1 - [Purpose]
The purpose of these Terms and Conditions is to stipulate the conditions and procedures for the use of 'Credits' required for the use of various paid services provided through the Internet services of IAID Inc. (hereinafter referred to as the "Company") and its website (https://iaidimage.co.kr, hereinafter referred to as the "Website").
Article 2 - [Effectiveness and Amendment of Terms]
β The contents of these Terms shall take effect by being announced on the Website or notified to members via e-mail or other methods.
β‘ Matters not specified in these Terms shall be governed by the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Consumer Protection in Electronic Commerce, the Electronic Financial Transactions Act, the Act on the Regulation of Terms and Conditions, and other applicable laws and regulations.
β’ The Company may amend these Terms if deemed necessary. If the amendment is disadvantageous to members, the Company shall notify members at least 30 days prior to the effective date; otherwise, at least 7 days in advance. Notification may be made via online posting or email. The amended Terms shall take effect from the effective date as announced or notified.
Article 3 - [Definitions]
β The definitions of terms used in these Terms are as follows:
1. Credit: A payment method purchased by a member to use the Company's medical data analysis services. Conversion rates are subject to the Website's notice. Credits are managed at the member account level, and may be charged, used, and refunded accordingly.
2. Charging: The act of purchasing Credits through payment methods provided by the Company.
3. Paid Services: Services that members can purchase and use for a fee, provided by the Company. Examples include:
β SarcInsight L3 Service: Provides immediate results by analyzing the L3 cross-section of a single DICOM series. Results are not stored and must be downloaded directly by the member.
β SarcInsight Auto Service: Provides results by automatically analyzing multiple DICOM series. Results are stored on the Company's server for three years, after which they are automatically deleted.
β Other analysis services separately announced by the Company.
4. Negative Credit: Refers to an amount owed when the member's current Credits are insufficient to cover Credits that must be withdrawn due to violations of the Terms or policies.
β’ For smooth use of paid services, members must comply with the following:
Article 4 - [Charging of Credits]
β Credits can be charged through payment methods such as credit/debit cards, PayPal, etc., provided by the Company. Where a payment method provider exists, members must follow the provider's procedures prior to use. Payment is deemed as acceptance of such procedures and terms.
β‘ Credits may only be charged in units determined by the Company's internal policies. Monthly charging limits may apply, and limits may differ depending on payment providers or government regulations.
β’ Displayed payment amounts for Credits include VAT.
β£ Upon request, the Company may issue receipts or tax invoices in accordance with applicable laws.
β€ In case of foreign currency payments, exchange rates follow the standards of the payment provider or settlement institution. Gains or losses arising from exchange rate differences on the payment/refund dates shall accrue to the member.
Article 5 - [Approval of Credit Payment]
β The Company may deny or cancel payment approval depending on the review results of PG companies, card companies, banks, or other payment providers, including in cases where:
1. The applicant is not using their real name.
2. Another person's identity is used or stolen.
3. Required information is omitted, misstated, or incomplete.
4. Service fees are unpaid or unverified.
5. Unauthorized payments are made without the consent of the payment method holder.
6. Other cases where approval is deemed impossible due to reasons attributable to the member or payment provider.
β‘ Approval may be restricted until issues are resolved if:
1. Service facilities are insufficient to provide satisfactory services.
2. System failures occur.
β’ The Company bears no responsibility for payment refusals caused by reasons attributable to payment providers (e.g., limit exceeded, insufficient balance, account suspension).
β£ If fraudulent use such as identity theft or minor payments is confirmed, approval may be canceled and refunds processed in accordance with laws and Company refund policies.
β€ For fraud prevention, AML, and KYC compliance, the Company may restrict payment applications, request additional documents, or require re-evaluation.
Article 6 - [Use of Credits]
β Credits may be used to pay for medical data analysis services and related functions. Usage history can be checked through methods provided by the Company.
β‘ Credits are deducted in the order they were charged.
β’ Services may be withdrawn if unused, and unused Credits will be refunded. However, if analysis has already started or results have been provided, withdrawal may be restricted under Article 17(2) of the Act on Consumer Protection in Electronic Commerce.
β£ No interest accrues on Credit balances.
β€ The Company operates result storage policies as follows:
1. SarcInsight L3 Service: Results are provided immediately and not stored.
2. SarcInsight Auto Service: Results are stored for three years and then deleted.
β₯ If Negative Credits occur, the Company offsets them against the next charging. If not resolved within a certain period, additional payment may be claimed. Service use may be restricted for non-payment.
Article 7 - [Withdrawal of Purchase Agreement]
β Members may withdraw from the Credit purchase agreement within 30 days of charging.
β‘ If the charged Credits differ from the displayed/advertised content or contract terms, members may withdraw within three months of charging or 30 days of discovery.
β’ Withdrawal requests must be made through the customer center. Refunds shall be directed to the payment provider within three business days after confirmation.
β£ Actual refund completion depends on the payment provider’s process. The Company is not responsible for delays after timely refund instruction.
β€ If the Company delays refund instructions due to intent or gross negligence, statutory delay interest shall be paid.
β₯ Costs related to withdrawal shall follow applicable laws.
Article 8 - [Effect of Withdrawal]
β Upon withdrawal, the Company deletes the member's Credits and directs refunds within three business days after confirmation.
β‘ Actual refund timing depends on the payment provider. The Company is not responsible for delays after timely instruction.
β’ If the Company delays refund instructions, statutory delay interest shall be paid.
Article 9 - [Refund of Credits]
β Even when withdrawal is not possible, unused Credits may be refunded, except for free promotional Credits.
β‘ Refund requests within 30 days of charging are eligible if the unused balance is at least 20 Credits. A 10% fee will be deducted. Refunds are processed within three business days after confirmation. Statutory delay interest applies if delayed.
β’ Refunds may be restricted if members violate laws or cause significant harm to service operation. Exceptions apply if the member proves otherwise.
β£ If a member voluntarily withdraws, unused Credits are not refunded, except when required by law or due to Company fault/service termination.
Article 10 - [Company's Obligations]
β If an overpayment occurs due to Company fault, the full amount shall be refunded without fees. Refunds follow the same method as payment unless impracticable.
β‘ The Company shall make best efforts to provide stable services in accordance with these Terms and applicable laws, except in cases of force majeure as defined in Article 16.
Article 11 - [Service Restrictions]
The Company may restrict service use or terminate membership for the following:
Article 12 - [Suspension of Service]
β The Company may temporarily suspend services if:
1. Maintenance, replacement, or upgrades of facilities are required.
2. Telecommunications services are suspended or fail.
3. Power outages, server failures, or force majeure events occur.
β‘ The Company may limit or suspend services if normal service provision is difficult due to national emergencies, natural disasters, network issues, or service overload.
β’ Members will be notified in advance of service suspensions, unless unavoidable.
Article 13 - [Disclaimer]
β The Company is not liable for failure to provide services due to force majeure (e.g., natural disasters, power outages, wars, regulations).
β‘ The Company is not liable for issues caused by members (e.g., misinformation, poor account management, unauthorized sharing).
β’ Analysis results may vary depending on input data, analysis conditions, and member choices. The Company is not liable for deviations unless caused by intent or gross negligence.
β£ The Company is not liable for the accuracy/reliability of member-uploaded data unless intent or gross negligence is proven.
β€ The Company may limit services as required by law, government policy, or regulators. The Company is not liable for resulting disadvantages.
β₯ The Company's liability is limited to the total service fees actually paid in the past three months, except in cases of intent, gross negligence, or harm to life/body.
Article 14 - [Governing Law and Jurisdiction]
β These Terms shall be governed by the laws of the Republic of Korea, except for mandatory provisions otherwise.
β‘ Disputes between the Company and members shall be governed by Korean law, and the competent court shall be the court having jurisdiction over the Company's principal office in Korea.
